1．相談の内容
株式会社A社は、アイドルの音楽を動画投稿サイトBに投稿する場合、その投稿が著作権を侵害するかどうかご相談されました。また、動画投稿サイトBは著作権に対して寛容であるという根拠についても知りたいということで弊所に相談されました。
2．解決策
動画投稿サイトBが著作権に関して寛容である理由は、日本音楽著作権協会（JASRAC）が、動画投稿サイトBとパートナーシップを結んでおり、JASRACで登録されている音楽を、動画投稿サイトBで提供されている音楽を使用する場合は著作権を侵害しないという取り決めがあるようです。基本的に、JASRACに登録されている音源で動画を投稿する際は問題ないのですが、JASRACに登録されている音源でも、CD音源、カラオケ音源などであった場合は、著作権を侵害することになるため、注意が必要です。その旨を、株式会社A社に伝えました。アイドルの姿をまねて動画投稿する際に、音楽だけではなく肖像権の問題も発生するため、十分な注意が必要です。

Why video sharing sites are tolerant of copyrights
1. Content of the consultation
Company A consulted us on whether posting idol music to video posting site B would infringe copyright. They also consulted us on the basis that video posting site B is tolerant of copyright.
2. Solution
The reason video posting site B is tolerant of copyright is that the Japanese Society for Rights of Authors, Composers and Publishers (JASRAC) has a partnership with video posting site B, and there seems to be an agreement that if music registered with JASRAC is used, music provided by video posting site B will not infringe copyright. Basically, there is no problem when posting a video with a sound source registered with JASRAC, but even if the sound source is registered with JASRAC, if it is a CD sound source, karaoke sound source, etc., it will infringe copyright, so care must be taken. We communicated this to Company A. When posting a video imitating the appearance of an idol, care must be taken not only about the music but also about portrait rights, as issues arise.
