1．相談の内容
A社は、健康器具の開発を行いました。健康器具の構造のアイデアが特徴的なことから、実用新案登録の出願を希望されました。また、出願にあたって、商品の様々なバリエーションをお考えでしたので、その件についても併せてご相談がありました。
2．解決策
実用新案は、物品の形状や構造、物品の組み合わせに関するアイデアを保護する制度です。申請する際に、同じ作用効果があり、同じ機能がある場合には、複数のバリエーションの組み合わせを一つの出願に含めることができます。今回の場合は、同じ機能を持つ様々なバリエーションもいくつか検討し、それらを弊所にて、図面化いたしました。
複数のバリエーションを申請することで、様々な形状の権利範囲を拡大することができます。また、他社の模倣を防止することができるというメリットがあります。
尚、権利行使をするためには、実用新案技術評価を請求した上でなければ、権利行使ができません。

3．結論
実用新案は、ちょっとしたアイデアに有効であり、登録までの期間が短いというメリットがあります。申請には専門的な知識が必要となる場合があるため、お困りの際は、是非弊所にご相談ください。

2.Solution
A utility model is a system that protects ideas related to the shape or structure of an article or a combination of articles. When filing an application, a combination of multiple variations can be included in a single application if they have the same effect and the same function. In this case, we considered several variations with the same function and made drawings of them at our office.
By filing multiple variations, the scope of rights for various shapes can be expanded. It also has the advantage of preventing imitation by other companies.
