1．相談の内容
株式会社A社は、自社の製品Bを知的財産権として、出願して権利化できないかどうか、弊所に相談されました。
2．解決策
株式会社A社の出願しようとしている製品Bを拝見し、その美的外観から特許出願や実用新案登録出願だけではなく、意匠登録出願も視野にいれました。また、意匠法第21条第2項によると「意匠権（関連意匠の意匠権を除く。）の存続期間は、意匠登録出願の日から二十五年をもつて終了する」とされており、特許の存続期間が20年、実用新案の存続期間が10年に対し、長く利用することができるため、意匠登録出願を勧めました。登録意匠出願を行うにあたり、製品Bに関する六面図を含む意匠図面と、製品Bに関して詳しく記述した意匠願書を制作しました。

Design registration applications and design drawings based on aesthetic appearance
1. Consultation details
Company A consulted us about whether it could apply for intellectual property rights for its product B and obtain the rights.
2. Solution
After looking at product B that Company A is planning to apply for, we decided to consider not only patent and utility model applications, but also design registration applications based on its aesthetic appearance. In addition, according to Article 21, Paragraph 2 of the Design Law, "The duration of a design right (excluding design rights of related designs) shall expire 25 years from the date of the application for design registration," which means that a design right can be used for a longer period of time than a patent, which has a duration of 20 years, and a utility model, which has a duration of 10 years. Therefore, we recommended a design registration application. In filing a design registration application, we created a design drawing including a six-sided drawing of product B, and a design application that describes product B in detail.
