特許表示の意味について

1．相談の内容
クライアントは新規の医療用器具を開発したいと考えており、この分野における他社の技術動向を知りたいと考え、弊所に相談しました。
2．解決策
特許庁の特許情報プラットフォームJ-PlatPatを用いて、関連する医療用器具についての特許・実用新案及び意匠を検索しました。その結果、簡易な構造のものであれば、他社の知的財産権を侵害するおそれは少ないことが分かりました。また、複雑な構造のものについては、複数の他社が知的財産権を取得していました。
そのため、クライアントが具体的な製品のアイデアが出てきた段階で、再度知的財産権の調査をすることで、他社の権利を侵害していないかを確認したり、クライアントのアイデアに新規性や進歩性があれば権利化も見込めると説明しました。

3．結論
新製品を開発するにあたっては、先行文献調査をすることで、公知技術と、他社が権利化している先行技術等を知ることができるため、製品開発の方向性の参考になります。弊所ででは、このような新製品開発のための先行文献調査を行っております。お気軽にご相談ください。

1. Content of the consultation
The client wanted to develop a new medical device, and consulted with us to learn about the technological trends of other companies in this field.
2. Solution
We used the Japan Patent Office's patent information platform J-PlatPat to search for patents, utility models, and designs for related medical devices. As a result, we found that if the device had a simple structure, there was little risk of infringing on the intellectual property rights of other companies. In addition, for devices with complex structures, multiple other companies had acquired intellectual property rights.
We therefore explained that by conducting another intellectual property rights investigation when the client had a specific product idea, we could check whether the device was infringing on the rights of other companies, and that if the client's idea was novel and progressive, it could be expected to be granted rights.

3. Conclusion
When developing a new product, a prior literature investigation can be used to learn about publicly known technologies and prior technologies that have been granted rights by other companies, which can serve as a reference for the direction of product development.
