特許出願における拒絶査定不服審判請求（化合物）

1．相談の内容
　クライアントは新規の化合物について、特許出願を行いましたが、拒絶査定を受けたため、弊所に相談しました。

2．解決策
　特許出願において拒絶査定を受けた場合には、拒絶査定不服審判を請求することができます。弊所では、拒絶査定不服審判を請求するための拒絶査定不服審判請求書と補正書を作成しました。
　拒絶査定を受けた理由は、明確性要件違反と進歩性違反ということでした。そこで、明確性要件違反については、不明瞭な記載を補正することで対応し、進歩性に関しては、請求の範囲を実施例に限定する補正を行い、これらの実施例については、拒絶理由に記載の引用発明よりも、顕著な効果を示すことを、出願当初明細書のデータに基づいて、反論し、進歩性を有するということを主張して対応しました。

3．結論

1. Content of the consultation

The client filed a patent application for a new compound, but received a rejection decision, so he consulted with us.

2. Solution

When a patent application is rejected, it is possible to request an appeal against the rejection decision. Our firm prepared a request for an appeal against the rejection decision and an amendment to request an appeal against the rejection decision.
