1．相談の内容
クライアントは新規に開発した情報システムについて特許権を取得したいと考え、弊所に相談されました。
2．解決策
この情報システムは、現在のトレンドであるChatGPTを用いて、ユーザと自然言語でやり取りすることが可能な情報システムです。ChatGPTは、自社のデータベースと連携させることが可能です。これによってChatGPT本体が持つ基本的な機能に加えて、自社データに基づく、より詳細で正確な情報を提供することができるようになります。
今回はクライアントがデータベースを持っているため、それを上手く活用し、ChatGPTと連携させるために、独自の方法を開発したことに新規性や進歩性があると考え、特許出願書類を作成しました。
尚、単にChatGPTとデータベースを連携させるだけでは、進歩性はないと考えられます。これは、特許庁の下記の審査基準において「ある特定分野に適用されるコンピュータ技術の手順、手段等を他の特定分野に単に適用するのみであり、他に技術的特徴がなく、この適用によって奏される有利な効果が出願時の技術水準から予測される範囲を超えた顕著なものでもないことは、進歩性が否定される方向に働く要素となる。」とされているからです。

3．結論
このようにChatGPT等の最新の技術を用いたシステムは今後も増えていくと考えられます。そのため、同様のシステムについて他社と差別化するには、まず自社のデータの付加価値を上げることや、それをより上手く活用できるような方法を開発することが重要になると考えられます。弊所では、最新の技術を用いた発明に関すると特許出願等の相談を承っております。お気軽にご相談ください。

1. Content of the consultation
The client consulted us because he wanted to obtain a patent for a newly developed information system.
2. Solution
This information system uses ChatGPT, which is a current trend, and is capable of communicating with users in natural language. ChatGPT can be linked to the company's own database. This makes it possible to provide more detailed and accurate information based on the company's own data, in addition to the basic functions of ChatGPT itself.
In this case, the client had a database, so we created a patent application document, thinking that there was novelty and inventiveness in developing a unique method to make good use of it and link it with ChatGPT.
However, simply linking ChatGPT with a database is not considered to be inventive. This is because the following examination criteria of the Japan Patent Office state that "the mere application of computer technology procedures, means, etc. that are applied to a specific field to another specific field, the absence of other technical features, and the advantageous effects achieved by this application that are not significant beyond the range predicted from the level of technology at the time of application are factors that work in the direction of denying inventiveness."

3. Conclusion
As such, it is expected that systems using the latest technologies such as ChatGPT will continue to increase in the future. Therefore, in order to differentiate similar systems from other companies, it is important to first increase the added value of your company's data and develop methods to make better use of it.
