1．相談の内容
株式会社A社は、自身の発明を特許として出願したいと考えており、弊所に相談されました。
2．解決策
一般的に、特許出願の発明の詳細な説明を記載する際に、文献公知発明の記載が必要となります。文献公知発明の記載は、刊行物の名称、その他の文献公知発明に関する情報の所在が必要になります。このことは、特許法第36条第4項第2号に記載されています。記載の内容は「その発明に関連する文献公知発明（第二十九条第一項第三号に掲げる発明をいう。以下この号において同じ。）のうち、特許を受けようとする者が特許出願の時に知つているものがあるときは、その文献公知発明が記載された刊行物の名称その他のその文献公知発明に関する情報の所在を記載したものであること」となります。今回のケースはすでに特許調査していたため、その特許調査の結果を文献公知発明として特許出願の発明の詳細な説明に記載しました。

Generally, when describing a detailed description of an invention in a patent application, it is necessary to include a description of inventions that are publicly known in the literature. In order to describe inventions known to the public through documents, the name of the publication and the location of other information regarding the inventions that are publicly known through documents are required. This is stated in Article 36, Paragraph 4, Item 2 of the Patent Law. The content of the statement is ``Among the inventions publicly known in the literature related to the invention (meaning the inventions listed in Article 29, Paragraph 1, Item 3; hereinafter the same shall apply in this item), the person who seeks to obtain a patent has a patent. If there is something known at the time of filing the application, the name of the publication in which the invention known to the public in the literature is described and the location of other information regarding the invention to the public in the literature must be stated.'' In this case, a patent search had already been conducted, so the results of the patent search were included in the detailed description of the invention in the patent application as an invention known to the public.
