1．相談の内容
株式会社A社は、考案Bを先行販売し、様々な小売店、卸売店に考案Bを販売してもらいました。考案Bの売り上げ状況が良好なので、考案Bの実用新案の申請ができるかどうかの相談を受けました。

2．解決策
株式会社A社の考案Bがいつ最初に販売されたのかを確認し、新規性喪失の例外規定を受けることができるかどうかを調べました。その結果、最初に販売された日が現在からみると、1年以内であることが分かり、新規性喪失の例外規定を受けることが可能なことを確認しました。考案Bの新規性喪失の例外規定の適用を受けるために、まず、株式会社A社や小売店、卸売店が、Webによって公開した考案Bの内容を一覧にした公開情報を制作しましたので、それらの情報を盛り込むことによってお店ごとに証明書を作成しました。具体的には、Web制作会社を通じて公開した日付、URL、株式会社A社自身の名前、考案Bを公開したWeb制作会社、公開された考案の内容の分かるものを弊所で証明書に載せました。また、株式会社A社における考案Bの内容をPDFでダウンロードできるようにWebで公開した内容、考案Bを紹介した展示会の内容に関しても、弊所で証明書を作成しました。
