1．相談の内容
クライアントは、既に販売中の健康器具について、知的財産権の取得を試みましたが、権利化できませんでした。そのため、この健康器具を改良し、新たに知的財産権による保護を受けたいと考え、弊所に相談に来られました。
2．解決策
クライアントの新しい健康器具に類似する特許文献について、特許庁の特許情報プラットフォームJ-PlatPatを用いて先行技術文献調査を行いました。その結果、同様の目的のために使用される健康器具の特許文献は見つかりましたが、構成要件が類似する先行文献は見つかりませんでした。そのため、クライアントの新製品には、新規性があると判断し、実用新案権の取得が可能ではないかと判断しました。
又、クライアントの新製品は、物品の美的外観に特徴があるため、意匠権による保護の可能性もあると判断しました。

3．結論
健康器具などの製品は他社による模倣を受けやすいため、知的財産権による保護を受けることが望ましいです。知的財産権を取得するには、その製品が新規性を有している必要があり、新規性の有無を判断するためには、先行文献調査が必要です。弊所では、知的財産権取得のための先行文献調査を行っております。お気軽にご相談ください。

1. Content of consultation
The client attempted to obtain intellectual property rights for health equipment that was already on sale, but was unable to do so. Therefore, they came to our office for consultation because they wanted to improve this health equipment and receive new intellectual property protection.
2. solution
We conducted a prior art literature search using J-PlatPat, the patent information platform of the Japan Patent Office, regarding patent documents similar to the client's new health equipment. As a result, we found patent documents for health equipment used for similar purposes, but no prior documents with similar structural requirements. Therefore, we determined that the client's new product was novel and that it might be possible to obtain a utility model right.
Additionally, since the client's new product has a distinctive aesthetic appearance, we determined that it may be protected by design rights.

3. conclusion
Products such as health equipment are susceptible to imitation by other companies, so it is desirable that they be protected by intellectual property rights. In order to obtain intellectual property rights, the product must be novel, and prior literature research is required to determine whether the product is novel.
