クライアントは、新規に開発したペット用品について、知的財産権を取得したいと考えており、知的財産権の取得の可能性について、弊所に相談した。

新規に開発したペット用品について、特許庁の特許情報プラットフォームJ-PlatPatやインターネット検索を用いて、特許権・実用新案権・意匠権について先行文献調査を行った。その結果、クライアントのペット用品に類似するものが複数あり、権利取得は難しいと判断した。権利を取得するためには、公知技術に加えて更なる工夫をすることで、新規性や進歩性を持たせる必要があると説明した。
3．結論

Regarding newly developed pet products, we conducted a search for prior literature regarding patent rights, utility model rights, and design rights using the Japan Patent Office's patent information platform J-PlatPat and Internet searches.
