今回は、弊所の実績をスタッフ（K）からご紹介します。
1．相談の内容
クライアントは、新規に開発した収納容器について、知的財産権を取得したいと考えており、知的財産権の取得の可能性について、弊所に相談した。
2．解決策
新規に開発した収納容器について、特許庁の特許情報プラットフォームJ-PlatPatやインターネット検索を用いて、特許権・実用新案権・意匠権について先行文献調査を行った。その結果、クライアントの収納容器について、特許文献は見つからなかったが、インターネット検索では複数見つかったため、新規性が無いと判断した。又、クライアントの収納容器は、既製品を単純に組み合わせただけのものであるため、進歩性もないと判断した。このため、クライアントに、知的財産権を取得するには、独自の工夫を加えることで、新規性や進歩性を持たせる必要があることを説明した。
3．結論
新規のアイデアについて知的財産権を取得するには、新規性や進歩性を備えている必要がある。先行文献調査によって、類似する特許文献が存在していなくても、インターネット検索等で既に公知になっている場合は、新規性はない。そのため、特許文献だけではなく、インターネット検索等も含めた非特許文献についても調査を行う必要がある。又、既存の製品を単純に組み合わせただけでは、新規性があったとしても、進歩性がないと判断されるため、独自の工夫が必要である。弊所では、知的財産権の取得のための相談を承っております。お気軽にご相談ください。

1. Content of consultation
The client wanted to acquire intellectual property rights for a newly developed storage container, and consulted our firm regarding the possibility of acquiring intellectual property rights.
2. solution
Regarding the newly developed storage container, we conducted a search for prior literature regarding patent rights, utility model rights, and design rights using the Japan Patent Office's patent information platform J-PlatPat and Internet searches. As a result, no patent documents were found regarding the client's storage container, but multiple internet searches were found, so it was determined that there was no novelty. Furthermore, since the client's storage container was simply a combination of ready-made products, it was determined that there was no inventive step. For this reason, we explained to the client that in order to obtain intellectual property rights, it was necessary to add originality and inventiveness to the project.
3. conclusion
In order to obtain intellectual property rights for a new idea, it must be novel and inventive. Even if a prior literature search reveals that no similar patent documents exist, if it is already publicly known through internet searches, etc., there is no novelty. Therefore, it is necessary to investigate not only patent documents but also non-patent documents, including Internet searches. Furthermore, simply combining existing products is considered to lack inventiveness even if there is novelty, so unique ideas are required.
