特許表示の意味について

今回は、弊所の実績をスタッフ（T）からご紹介します。
1．相談の内容
電気装置を駆動する際に、携帯端末と電気装置とを無線通信で接続して、操作するアプリを開発したので、そのアプリの特許調査のご依頼がありました。
2．解決策
まず、キーワード検索を行い、類似の先行技術文献を発見しました。キーワード検索では見つけきれない先行技術文献については、IPCを用いてコード検索を行い、より近い先行技術文献を発見しました。その際に、先行技術文献には、今回のアプリの機能の一部が開示されていました。また、この先行技術文献では、拒絶査定となっていましたので、拒絶査定の中の引用文献を調べ、相談の内容に関するアプリの技術と類似するものがすでに存在することを確認しました。そのため、今回のアプリの新規性はない可能性があると判断しました。
3．結論
新しく開発したアプリについて、特許を取得できると考えている場合であっても、他人が先に特許出願をして拒絶査定になっている場合があります。そういった調査は、アプリの改良に役立ちます。開発品が特許取得可能かどうかを検討したい方は、ご連絡下さい。

1. Content of consultation
We developed an app that connects and operates an electrical device via wireless communication with a mobile device, and we received a request for a patent search for the app.
2. solution
First, we conducted a keyword search and found similar prior art documents. For prior art documents that could not be found through keyword searches, we conducted a code search using IPC to discover closer prior art documents. At that time, some of the functions of this app were disclosed in the prior art document. In addition, this prior art document contained a decision of refusal, so we checked the cited documents in the decision of refusal and confirmed that there was already a technology similar to the app's technology related to the contents of the consultation. Therefore, we have determined that this app may not be novel.
3. conclusion
Even if you think you can obtain a patent for a newly developed app, someone else may have filed a patent application first and the application was rejected. Such research helps us improve the app. If you would like to consider whether your developed product can be patented, please contact us.
