トレーニング測定器の意匠について

今回は、弊所の実績をスタッフ（I）からご紹介します。

1．相談の内容
A社はトレーニング機器の開発を行いました。A社のトレーニング機器に付属するセンサー部分は、形状が特徴的であることから、意匠登録の出願をご希望され、ご相談を受けました。また、出願するにあたって、図面の作成についても併せてご相談がありました。

2．解決策　
今回は、トレーニング機器のセンサー部分について、部分意匠の出願をお勧めし、弊所にて、出願書類とともに図面も作成いたしました。

意匠法第六条に「意匠登録を受けようとする者は、・・・願書に意匠登録を受けようとする意匠を記載した図面を添付して特許庁長官提出しなければならない。」とあります。出願するには、「意匠図面」が必要となります。

立体形状の物を描くのは、少し難しいのですが、6つの視点（正面図・背面図・右側面図・左側面図・平面図・底面図）から描くことで、お客様が考えたデザインを全方向から見た形状をしっかりと伝えることができます。
気を付けなければならないのは、図面が明確で分かりやすくなるように、いくつかのルールがあることです。特許庁のHPにある「意匠登録出願の願書及び図面等の記載の手引き」https://www.jpo.go.jp/system/laws/rule/guideline/design/h23_zumen_guideline.html
が参考になるかと思います。

今回はお客様から提供された資料をもとに、六面図の作成と斜視図、使用参考図を作成しました。作成の際に、図面全体の見やすさや分かりやすさに影響する「線」は、大事なポイントとなるかと思います。具体的な線の太さや数値等は、描く物体によって変わるため、一概には言えませんが、全体の形状を示す主要な線（例えば、製品の輪郭など）は太線で、製品の全体の形にはあまり影響しない内部の詳細を描く線（例えば、カーブや装飾）は細い線で描くことが多いです。
可能であれば図面依頼の際に、製品写真やスケッチなどがあると作図もスムーズに仕上がります。

3．結論

Company A has developed a training device, and because the sensor part attached to the training device has a distinctive shape, the company consulted with us about applying for a design registration. The client also consulted with us regarding the preparation of drawings for the application.

2.Solution
We recommended filing a partial design application for the sensor portion of the training device, and we prepared the application documents and drawings.
Article 6 of the Design Act states that "A person who desires to obtain a design registration ... shall submit to the Commissioner of the Patent Office an application accompanied by drawings describing the design for which the design registration is sought. The application must be accompanied by drawings describing the design for which the application is sought to be registered. In order to file an application, "design drawings" are required.
It is a little difficult to draw a three-dimensional object, but by drawing from six viewpoints (front view, back view, right side view, left side view, plane view, and bottom view), you can clearly convey the shape of your design from all directions.

In this case, based on the materials provided by the client, we created a six-sided drawing, a diagonal view, and a reference drawing for use. When creating the drawing, I think that "lines" are an important point as they affect the ease of viewing and understanding of the entire drawing. Although it is difficult to say exactly how thick the lines should be and what values they should have, as they vary depending on the object being drawn, we often use thick lines for major lines that indicate the overall shape (e.g., product outlines) and thin lines for internal details (e.g., curves and decorations) that do not affect the overall shape of the product so much.
If possible, product photos or sketches are helpful when requesting drawings.
