1．相談の内容
クライアントは、新しく電子機器を用いたサービスを始めたいと考えている。しかしながら、競合他社が先行で同様のサービスを実施していることが分かった。このため、この競合他社の知的財産権を侵害する恐れがあったため、弊所に相談した。
2．解決策
今回のサービスに用いる電子機器について、特許文献調査によって、競合他社は権利を取得していないことが分かり、侵害の恐れは無いと考えられたが、確実に競合他社の知的財産権を侵害する事態を回避したいと考えた。そのため、実用新案登録出願をし、技術評価書を取得することを提案した。ここで技術評価書において、新規性や進歩性が無いと判断されれば、当該電子機器が公知技術であるため、実施しても他社の権利侵害とはならないという特許庁からの評価を得ることができる。
3．結論
