先行文献調査（健康器具）

今回は、弊所の実績をスタッフ（K）からご紹介します。

1．相談の内容
クライアントは、新開発の健康器具に関して、知的財産権による保護を受けることができないか考えており、弊所に相談した。

2．解決策
特許庁の特許情報プラットフォームJ-PlatPatや、インターネット検索によって、特許権、実用新案権及び意匠権について先行文献調査を行った。その結果、部分的に類似するものが複数見つかった。又、特許権を取得している類似の先行技術についても調査し、どのような構成要件を備えていれば、新規性・進歩性が認められそうかを調べた。その結果、特許権や実用新案技術評価6を取得することを考えた場合、新規性はありそうだが、進歩性については判断が難しいため、実験データや計算機シミュレーション等のより具体的なデータを追加することで、発明の効果を示すことができれば、より権利化しやすいと提案した。

3．結論
新規に開発した製品を競合他社に模倣されること等を防ぐには、知的財産権を取得することが有効であり、そのためには先行文献調査が必要である。しかしながら、特許権や実用新案技術評価6を得るには、新規性に加えて進歩性を有する必要がある。そこで、特許権を取得した先行技術などを参考にしながら技術開発することが望ましい。弊所では、知的財産権取得に関する相談を承っております。お気軽にご相談ください。

1. Content of consultation
The client was considering whether it would be possible to obtain intellectual property protection for newly developed health equipment, and consulted our firm.

2. Solution
We conducted a search for prior literature regarding patent rights, utility model rights, and design rights using the Japan Patent Office's patent information platform J-PlatPat and Internet searches. As a result, several partially similar items were found. We also investigated similar prior art for which patent rights have been obtained, and examined what constituent elements would be required to qualify for novelty and inventive step. As a result, when considering obtaining patent rights and utility model technology evaluation 6, it seems that there is novelty, but it is difficult to judge inventive step, so more specific data such as experimental data and computer simulations are added. He proposed that if the effectiveness of the invention could be demonstrated by doing so, it would be easier to obtain rights.

3. Conclusion
In order to prevent newly developed products from being imitated by competitors, it is effective to obtain intellectual property rights, and to do so, it is necessary to research prior literature. However, in order to obtain patent rights and utility model technology evaluation6, it is necessary to have inventive step in addition to novelty. Therefore, it is desirable to develop technology while referring to prior art for which patent rights have been obtained.
