知的財産権を活用した新規参入について

今回は、弊所の実績をスタッフ（T）からご紹介します。

1．相談の内容
株式会社A社は、他社が自社の取り扱い可能な他社製品を高額で販売されているのを発見しました。株式会社A社ならもっと安く販売できると判断し、その他社の市場に参入するために、自社でその商品の知的財産をとることができないか相談を受けました。

2．解決策
他社製品の取得状況を調査しました。その結果、他社は、他社製品のネーミングを商標として取得していることが分かりました。また、他社製品の構造は、ありふれているため、特許や実用新案、意匠を取得する可能性が低いことが分かりました。そこで、株式会社A社に新たなネーミングを検討してもらい、そのネーミングを商標として出願しました。

3．結論

We investigated the acquisition status of other companies' products. As a result, we discovered that other companies had acquired the names of other companies' products as trademarks. It was also found that because the structures of other companies' products are commonplace, there is a low possibility of obtaining patents, utility models, or designs. Therefore, we asked Company A Co., Ltd. to consider a new name and applied for that name as a trademark.
