特許侵害予防調査（測定器）

今回は、弊所の実績をスタッフ（K）からご紹介します。

1．相談の内容
クライアントは、ある物理現象を利用したスポーツ用の測定器を開発しようとしている。そこで、他社が、この物理現象を利用した測定器でどのような測定データを取得し、それに基づく特許権を取得しているのかどうかや、どこまで他社の権利を侵害せずに発明の実施が可能なのかを知りたいと考え、弊所に相談した。

2．解決策
特許庁の特許情報プラットフォーム「J-PlatPat」を用いて、特許文献調査を行った。調査の結果見つかった特許文献の中には、明細書や図面の中に、この物理現象を利用した測定器の実際の測定データの例を載せているものがあった。これによって、どのようなデータが実際に取得され、どのような処理や分析がなされているのかを知ることができた。又、他社の特許権の権利範囲なのか、そうではない公知技術なのかについても、判断した。

3．結論
特許文献調査によって、他社の特許権の権利範囲を見極め、権利侵害を回避することができる。又、具体的なデータ等についての情報を得ることもできるため、技術開発の参考とすることができる。弊所では、他社の特許侵害の有無の調査や、具体的な技術の調査等を行っております。お気軽にご相談ください。

1. Content of consultation
The client is trying to develop a measuring device for sports that uses a certain physical phenomenon. Therefore, it is important to know what kind of measurement data other companies have acquired with measuring instruments that utilize this physical phenomenon, whether they have acquired patent rights based on this data, and to what extent they can implement their inventions without infringing on the rights of other companies. I wanted to know if this was the case, so I consulted our office.

2. solution
We conducted a patent literature search using the Japan Patent Office's patent information platform "J-PlatPat." Among the patent documents found as a result of the research, there were some that included examples of actual measurement data of measuring instruments that utilized this physical phenomenon in the specifications and drawings. This made it possible to learn what kind of data was actually acquired and what kind of processing and analysis was being done. We also determined whether the patent was within the scope of another company's patent rights or whether it was a publicly known technology.

3. conclusion
By searching patent documents, you can determine the scope of other companies' patent rights and avoid infringement. In addition, since it is possible to obtain information on specific data, etc., it can be used as a reference for technology development.
