1．相談の内容
クライアントは、新開発の健康器具に関して、包括的な権利保護を考えており、これらの出願に関して弊所に相談した。
2．解決策
特許権や実用新案権は、自然法則を利用した技術的思想の創作に関する知的財産権であり、意匠権は、物品の形状等であって視覚を通じて需要者に美感を起こさせるものに関する知的財産権である。実用新案権では、技術を様々な実施形態によって保護することが可能であり、意匠権では、物品の具体的な形状を確実に保護することが可能である。そのため、実用新案登録出願では、健康器具の技術的な構成要件を抽出し、様々な実施形態について権利取得できるように実用新案登録請求の範囲や明細書を記載した。意匠登録出願では、健康器具の特徴的なデザイン部分を部分意匠として権利取得できるように図面等を記載した。
3．結論

Patent rights and utility model rights are intellectual property rights related to the creation of technical ideas that utilize the laws of nature, and design rights are intellectual property rights related to the shape of an article that arouses a sense of beauty in the consumer through the visual sense. It is a property right. With utility model rights, it is possible to protect technology through various embodiments, and with design rights, it is possible to reliably protect the specific shape of an article. Therefore, in the utility model registration application, the technical constituent features of the health appliance were extracted, and the claims and specifications for the utility model registration were written so that rights could be obtained for various embodiments. In the design registration application, drawings and other information were included so that the unique design parts of health equipment could be patented as partial designs.
3. Conclusion
Regarding this health equipment, the technical characteristics are directly reflected in the aesthetic appearance of the product, so it is effective to obtain comprehensive protection based on technology and aesthetic appearance by acquiring utility model rights and design rights at the same time.
