商標の登録可能性について

今回は、弊所の実績をスタッフ（T）からご紹介します。

1．相談の内容
株式会社A社から「B＋C」という商標について、食品と店舗を使用する予定ですが、この「B＋C」という商標に識別力があるかどうか、取得可能かどうか相談がありました。

2．解決策
J-platpatを用いて「B」と「C」という商標名について、それぞれの登録例を調べた。例えば、商標「B」の区分29類の指定商品「食品」について、過去登録した例があったが、既に権利が消滅していることが分かった。同様に、商標「B」の区分43類の指定役務「飲食物の提供」について、過去登録した例があった。また、商標「C」についても同様であった。これらの結果により「B」と「C」の組み合わせには識別力があることを確認しました。また、取得可能性があることを説明した。

Company A Co., Ltd. plans to use the trademark ``B+C'' for food and stores, and asked us if the trademark ``B+C'' has distinctiveness and whether it is possible to obtain one.

Using J-platpat, we investigated the registration examples of the trademark names "B" and "C." For example, there was a case where the trademark "B" was registered in the past for a designated product "food" in Category 29, but it was found that the rights had already expired. Similarly, there was an example of trademark "B" registered in the past for the designated service "provision of food and drink" in Class 43. The same was true for the trademark "C". These results confirmed that the combination of "B" and "C" has discriminative power. He also explained that there is a possibility of acquiring it.
