先行技術文献調査（土木技術）

今回は、弊所の実績をスタッフ（K）からご紹介します。

1．相談の内容
クライアントは、新たな土木技術について特許権を取得したいと考えており、弊所に相談した。

2．解決策
クライアントの発明した土木技術に関連する先行技術文献調査を行った。特許庁の特許情報プラットフォーム「J-PlatPat」及びインターネット検索を行った。その結果、クライアントの発明した土木技術は、公知技術であることが分かった。他社の特許文献を見ると、本技術に、新規の構成要件を追加した発明が複数あった。このため、クライアントに、新規の構成要件を追加しないと新規性がないため、特許権の取得は難しいと説明した。

3．結論
先行技術文献調査によって、公知技術を見極めると共に、他社の先行技術文献を参考にする等して、独自の構成要件を含む発明をすることが必要である。弊所では、公知技術の調査や新規性の有無に関する相談等を行っております。お気軽にご相談ください。

1. Content of consultation
The client wanted to obtain patent rights for a new civil engineering technology and came to our firm for consultation.

2. Solution
We conducted a search of prior art documents related to the civil engineering technology invented by the client. We searched the Japan Patent Office's patent information platform "J-PlatPat" and the internet. As a result, it was found that the civil engineering technology invented by the client was a publicly known technology. Looking at the patent documents of other companies, there were multiple inventions that added new structural requirements to this technology. For this reason, we explained to the client that it would be difficult to obtain patent rights because there would be no novelty unless new structural requirements were added.

3. Sonclusion
It is necessary to identify known technologies through a search of prior art documents and to create an invention that includes unique constituent elements by referring to other companies' prior art documents.
