医療機器の先行技術文献調査について

1．相談の内容
クライアントは、医療機器に関する発明について、特許権を取得したいと考えており、そのための先行技術文献調査を弊所に依頼した。

2．解決策
類似の医療機器に関する先行技術文献調査を行った。調査は、特許庁の特許情報プラットフォーム「J-PlatPat」やインターネット検索によって行った。その結果、類似の医療機器に関する論文が、他の研究機関によって発表されていた。そのため、クライアントの発明には新規性がないため、特許権を取得するには、別の構成要件を追加する必要があることを説明した。

3．結論

2. Solution

Therefore, we explained that since the client's invention was not novel, it was necessary to add other constitutional requirements in order to obtain patent rights.

3. Conclusion

In order to determine whether there is novelty, it is necessary to conduct a search of prior art documents, and prior art documents include not only patent documents but also academic papers.
