海外商標登録出願での拒絶理由通知対応について

今回は、弊所の実績をスタッフ（K）からご紹介します。

1．相談の内容
クライアントは、海外のA国に、食料品に関する商標の登録出願をした。その結果、A国の特許庁から、他社が類似の区分で、称呼が同一の商標を先に登録しているため、登録できないという拒絶理由通知を受けた。弊所は、その対応について依頼を受けた。

2．解決策
この他社が、登録商標をA国において、実際に使用しているかについて、使用実態調査を行った。具体的には、インターネット検索によって、A国で、この他社が登録商標を使用した商品やサービスを提供しているかを調べた。その結果、A国において、この他社は登録商標を使用していない可能性があることが分かった。このため、パリ条約第5条の規定により、商標不使用取消審判によって、この商標登録を取り消せば、拒絶理由が解消し、クライアントが商標登録できるかもしれないと説明した。

3．結論
日本と同様に海外においても、権利者が、登録商標を使用していなければ、不使用となり、不使用取消審判で登録の取消をできる可能性がある。このため、海外で、既に登録商標がある場合でも、日本と同様に、使用実態を調査することで、登録を取り消すことができる可能性がある。

1. Content of consultation
The client applied for registration of a trademark related to food products in overseas country A. As a result, we received a notice of reasons for refusal from the patent office of Country A stating that the trademark could not be registered because another company had previously registered a trademark with the same name in a similar category. Our office was asked to respond to this request.

2. Solution
A usage survey was conducted to determine whether this other company was actually using the registered trademark in Country A. Specifically, we conducted an Internet search to find out whether this other company was providing products or services using the registered trademark in Country A. As a result, it was found that this other company may not be using the registered trademark in Country A. For this reason, we explained that pursuant to the provisions of Article 5 of the Paris Convention, if this trademark registration is canceled through a trademark non-use cancellation trial, the reasons for refusal will be resolved and the client may be able to register the trademark.

3. Conclusion
As in Japan, overseas as well, if a right holder does not use a registered trademark, it will be considered unused and there is a possibility that the registration can be canceled through a non-use cancellation trial. Therefore, even if a trademark is already registered overseas, it may be possible to cancel the registration by investigating the actual usage, just as in Japan.
