特許権取得に関する相談について

今回は、弊所の実績をスタッフ（K）からご紹介します。

1．相談の内容
クライアントは、自身が発明した玩具装置について特許権を取得できないかを考えており、弊所に相談に来られた。

2．解決策
特許庁の「特許情報プラットフォームJ-PlatPat」とインターネット検索を用いて、類似する技術に関する先行技術調査を行った。その結果、玩具装置ではないが、類似の技術を使用した特許文献や公知例が見つかった。そのため、この玩具装置は、新規性がないことを説明した。そこで、玩具装置という特性に着目し、デザインや趣向性の観点から、新しい要素を加えることで、新規性を獲得することができるかもしれないと説明した。

3．結論

The client came to our office for advice as he was considering whether he could obtain a patent for a toy device he had invented.

2. Solution
We conducted a prior art search for similar technologies using the Japan Patent Office's "Patent Information Platform J-PlatPat" and internet searches. As a result, patent documents and known examples using similar technology were found, although they were not toy devices. Therefore, it was explained that this toy device is not novel. Therefore, he explained that by focusing on the characteristics of toy devices and adding new elements from the perspective of design and taste, it may be possible to obtain novelty.

3. Conclusion
In order to obtain rights for an idea, it is important to determine whether the idea is novel by conducting a prior art literature search.
