今回は、弊所の実績をスタッフ（I）からご紹介します。

1．相談の内容
ABC社がホームページにYouTubeの動画アップを希望している。ABCという言葉で動画をアップできるか、また仮に「ABCチャンネル」というアカウントで動画を配信したら、侵害にあたるかのご相談。もし他社が使用していた場合、使用したら争いになる可能性が考えられるので、その前に使用できるかを確認したい。

2．解決策
XYZ社が「ABCチャンネル」という商標を取得済みであり、登録者多数のYouTube番組も持っている。XYZの指定商品・指定役務の中に動画配信等があるかどうかの確認をした。またXYZ社が「ABCチャンネル」のアカウントで動画配信をしているかの確認をした。

3．結論
XYZのYouTubeアカウントは別名（ABCチャンネルではない）であり、ABCチャンネルという言葉を用いた動画はなかった。ただ、ホームページを確認するとABCチャンネルのページがあることが分かった。
XYZの指定商品・指定役務を確認すると、「ABCチャンネル」で35類、36類の商標を取得している。一方、ABC社は41類で「ABC」の権利を取得していて、指定役務が違う為、法的には侵害の可能性は低い。もし、「ABCチャンネル」の使用を希望するのであれば、他社が「ABCチャンネル」（41類）の出願を防止するためにも、現在、ABC社が商標登録をしている指定商品・指定役務に加え、「ABCチャンネル」（41類）でも権利を取得されたらどうかと提案した。こういったきわどい内容は、ご相談ください。

3. Conclusion
XYZ's YouTube account is an alias (not an ABC channel), and there were no videos using the term ABC channel. However, a check of the website showed that there was an ABC Channel page.
When we checked XYZ's designated products and services, we found that the company had obtained the trademark "ABC Channel" in categories 35 and 36. On the other hand, ABC Inc. has obtained the right to "ABC" in Class 41, and since the designated services are different, there is little possibility of legal infringement. If you wish to use "ABC Channel", we suggest that you obtain rights to "ABC Channel" (in Class 41) in addition to the designated goods and designated services for which ABC Inc. currently has a trademark registration, in order to prevent other companies from filing applications for "ABC Channel" (in Class 41).
